Dear Mr. Thomas,
I received your letter dated June 7, 2006, for which I am most obliged, and I have, of course, noted the contents most carefully. The questions raised in your Paragraph 3 are being seriously considered by the Governing Council of the Association, taking into consideration the contents of your Report - What Price Privacy.
As an Association, we are of course concerned when we see that the Lord Chief Justice is publicly suggesting that persons convicted of offences involving violence, theft and public order, should have their prison sentences reduced or indeed they should not be imprisoned at all. It does appear to us to be totally out of context when your Report is suggesting that Parliament should legislate for longer terms of imprisonment for “social” offences.
On a personal note, I do feel that the prisons would be better filled with those that commit crimes of violence, crimes against old and vulnerable people and crimes against Public Service employees, rather than those that, in their attempts to track down social misfits and offenders, breach European mandated legislation. However, we all hope to work towards an acceptable resolve when Government accepts that the public at large are better served by controlled access to personal data rather than outright bans.
